Since 1999 the Teatro di San Carlo has been a private non-profit foundation whose  goals include the diffusion of music and the preparation and training of future artists.

The new Theatre Statute governs the inflow of private capital, through the creation of two sponsoring bodies: the "Soci Fondatori" (Founding Members. They can designate a representative on the board of directors according to statutory rules governing contributions) and the "Soci Sostenitori" (Subscribing Members), may consent to have their contributions added to the contributions made by the Founding Members in order to acquire the right to designate a representative on the board of directors.

The budgets of the Fondazione San Carlo are sent - under Article .16, paragraph 5, of D. Decree Law 367/1996 - within thirty days from their approval to the Ministry of Economy and deposited with the Register of Companies kept by the Chambers of Commerce Industry and Agriculture.
Therefore they are accessible to third parties by request to the Chamber of Commerce of Naples.
